Information On The Processing Of Personal Data Pursuant To Article 13 Of Regulation (Eu) 2016/679 (“GDPR”)

With this notice, AQUARDENS SPA provides Data Subjects with information on the processing of personal data concerning them.

Who processes the personal data                  

The Data Controller, i.e., the entity that determines the purposes and means of the processing of personal data, is AQUARDENS SPA, located at Via Valpolicella, 63 - 37026 Pescantina (VR), who can be contacted at the email: privacy@aquardens.it

Data Protection Officer (DPO)                

The Owner has designated a Data Protection Officer who can be contacted at dpo@aquardens.it.

Purpose, legal basis and principles of processing                  

The collection and processing of personal data is carried out for the following purposes and under the respective legal bases:

- Purpose
Collection, publication and dissemination of photo and/or video content related to events and/or promotional events and/or photo shoots organized by the Data Controller

- Legal basis (art. 6 GDPR)
Legitimate interest of the Data Controller in the dissemination of its initiatives and activities through the company's internet and social channels

The Data Controller balances the legitimate interest, identified in the dissemination of its initiatives and activities through the company's internet and social channels, with the rights and freedoms of the data subject through data minimization (e.g. through the prevalent use of panoramic images that do not allow for the unambiguous identification of the Data Subjects, or by refraining from collecting images targeting so-called vulnerable subjects such as minors) and by providing the Data Subject with the necessary information to avoid any undesired processing of personal data. In particular, the Data Controller notifies the subjects of the photos of the filming/photographing in progress through the posting of appropriate, clearly visible signs. The photographer and/or videomaker is also identifiable by means of a special badge and provides for signaling their presence in case of closer filming, so that those who wish to do so can avoid being photographed and/or videotaped.

Nature of the provision of data
The provision of data is optional and failure to provide it does not entail any consequences for the Data Subject.

Communication and dissemination of data            

Without prejudice to compliance with the regulations in force, personal data will be communicated, exclusively for the pursuit of the purposes mentioned in this statement, to: 

♣   Supply and/or promotional partners exclusively for the pursuit of the purposes mentioned above;

♣   Subjects authorized to access the data by the regulations in force and/or to whom of data must be communicated in execution of legal      obligations.             

Personal data may be processed by the employees and collaborators assigned to the competent offices of the Data Controller, who are explicitly authorized to process the data on the basis of Article 29 of the GDPR and current national legislation.

Data transfers abroad                 

Data may be communicated and/or transmitted abroad by the Data Controller only within the limits of the provisions of Article 44 et seq. of GDPR 2016/679. The social networks and/or online platforms on which the content will be published act as autonomous Data Controllers, in accordance with their own policies. It is also specified that the material acquired, once made public, may subsequently be republished by third parties even without the consent of the Data Controller and without the Data Controller itself being able to intervene in any way on further sharing

Data retention times                  

The data provided will be stored in our systems and may be used, communicated and disseminated or in any other form made available in connection with the purposes set forth in this policy, and in any case up to a maximum of 5 years.

Rights of the Data Subject    

The Data Subject has the right to obtain, in the cases provided for, access to his or her personal data and the rectification or erasure thereof or the restriction of the processing that concerns him or her, or to object to the processing (Art. 15 et seq. of the GDPR), by contacting the Data Controller at privacy@aquardens.it or by registered letter with return receipt. 

Right to Complain       

A Data Subject who believes that the processing of personal data relating to him or her is taking place in violation of the provisions of the GDPR has the right to lodge a complaint with the Data Protection Authority, as provided for in Article 77 of the GDPR itself, or to take appropriate legal action (Article 79 of the GDPR).
